ChaseBuy's User Agreement This User Agreement ("Agreement") is a contract between you and ChaseBuy and applies to your use of ChaseBuy's services. Like all contracts, you must be at least 18 years of age to be eligible. You must read, agree with and accept all of the terms and conditions contained in this Agreement. We may amend this Agreement at any time by posting a revised version on our website. The revised version will be effective at the time we post it. In addition, if the revised version includes substantial changes, we will send a message to all members' Inbox. We last modified this Agreement on May 18, 2012. Our Relationship With You ChaseBuy is a provider of information with an unique approach to help foster businesses online. ChaseBuy helps you make payments to and accept payments from third parties through available credits you and other members maintain on the system or by linking you to a payment processing company like PayPal. ChaseBuy helps you ship items to and receive items from third parties by efficiently connecting you to a shipping carrier like UPS. ChaseBuy is much like yourself an independent contractor for all purposes on the site. ChaseBuy does not have control of or liability for the products or services that are sold thru our site. We do not guarantee the identity of any user or ensure that a buyer or a seller will complete a transaction. Privacy Protecting your privacy is very important to ChaseBuy. We store and process your information on computers located in the United States that are protected by physical as well as technological security devices. We are committed to maintaining your privacy, as well as our use and disclosure of your information. Likewise, we require that you respect the privacy of others. If you receive information about another ChaseBuy user through the service, you must keep the information confidential and only use it in connection with the service. You may not disclose or distribute a ChaseBuy user's information to a third party or use the information for marketing purposes unless you receive the user's express consent to do so. ChaseBuy does not ask for, store, or in any way process your personal financial information. We simply redirect you to PayPal's website to complete any transactions that require access to your funds/credits outside of ChaseBuy. When users are involved in a transaction, they may have access to the other party's shipping address and email. No other information is ever given out by us in the process. All members can communicate and network at any time through our messaging service. Therefore, we encourage you to evaluate your trading partner before entering into a transaction and sharing additional information that is not necessary. A good indication is their Rating Percentages. In all cases, you must give other users a chance to remove your address from their database and a chance to review what information you have collected about them. Your password is the key to your account. Use various numbers, letters and special characters, and do not disclose your ChaseBuy password to anyone. If you do share your password or your personal information with others, remember that you are responsible for all actions taken in the name of your account. If you lose control of your password, you may lose substantial control over your personal information, available funds, and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason and unable to login, you should immediately notify ChaseBuy. Your information is stored on our servers located in the United States. We treat data as an asset that must be protected and use lots of tools (encryption, passwords, physical security, etc.) to protect your personal information against unauthorized access and disclosure. However, as you probably know, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information that they collect from the site. Therefore, although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private. Intellectual Property "ChaseBuy.com", "ChaseBuy", and all related logos, products and services described in our website are either trademarks or registered trademarks of ChaseBuy or its licensors. You may not copy, imitate or use them without ChaseBuy's prior written consent. In addition, all page headers, custom graphics, button icons, and scripts are service marks, trademarks, and/or trade secrets of ChaseBuy. You may not copy, imitate, or use them without our prior written consent. Account Balances You do not need to maintain a balance in your account in order to make payments. If you do hold a balance, ChaseBuy will hold your funds separate from its corporate funds, will not use your funds for its operating expenses or any other corporate purposes and will not voluntarily make your funds available to its creditors in the event of bankruptcy. While your funds are in our custody, ChaseBuy will combine your funds with the funds of other users and place them in one or more FDIC insured bank accounts under ChaseBuy's name. You may withdraw any or all of your Available Credits thru PayPal using just your email address. We may delay withdrawals of large sums of money while we screen for risk. You may also close your account at any time. In addition to your Available Credits, we will automatically pay out any Shares you have at the current price per share. Any Pending Credits you have will belong to your current Upline. However, you will not be able to make a withdrawal or close account while we are conducting an investigation. We may hold your funds for up to 180 days to protect ChaseBuy or a third party against the risk of reversals, chargebacks, claims, fees, fines, penalties and other liability. Prohibited and Restricted Items Before you list your item, you need to find out if your item is allowed on ChaseBuy and if the type of item is subject to certain restrictions to avoid potential issues with your listing. As a ChaseBuy seller, you are ultimately responsible for making sure that selling an item is legal in the eyes of the law. We provide only a meeting place conveniently offering the services of other companies to encourage businesses online in a unique way. We are not involved in the actual transaction between buyers, sellers and promoters. We have no control over and do not guarantee the quality, safety or legality of items advertised, the truth or accuracy of users' content or listings, the ability of promoters to recommend items, the ability of sellers to sell items, the ability of buyers to pay for items, or that a buyer or seller will actually complete a transaction. Release If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. Indemnity You will indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures and employees), harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party. No Agency No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement. Notices Except as explicitly stated otherwise, legal notices can be served to ChaseBuy at our contact link under About (in the case of ChaseBuy) or to the email address you provide to ChaseBuy during the registration process (in your case). Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you legal notice by mail to the address you provided under Account. In such case, notice shall be deemed given three days after the date of mailing. Resolution of Disputes We strongly encourage you to first contact us directly to seek a resolution to any dispute you may have with us by going to our About page. Our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.
